1. Acceptance of Terms

By visiting our Site, creating an account, submitting an order, or otherwise interacting with our digital or physical services, you affirm that:

Dewey's Pizza is a food service business operating in the United States. Through the Site deweys-pizza.click, we offer the following services:

4.2 Technical Prohibited Conduct

  • Attempting to gain unauthorized access to any portion of the Site, or any other systems or networks connected to the Site;
  • Using any robot, spider, crawler, scraper, or other automated means to access the Site for any purpose without our express written permission;
  • Transmitting any viruses, malware, trojans, or other harmful computer code through the Site;
  • Attempting to decipher, decompile, disassemble, or reverse-engineer any of the software comprising the Site;
  • Interfering with or disrupting the integrity or performance of the Site, servers, or networks;
  • Using any content or information obtained from the Site to transmit unsolicited commercial communications (spam).

4.3 Content Prohibitions

  • Posting, uploading, or transmitting any content that is defamatory, obscene, offensive, hateful, or otherwise objectionable;
  • Submitting any content that infringes on any patent, trademark, copyright, trade secret, or other intellectual property right of any party;
  • Posting any content that contains personal or confidential information about another individual without their consent.

Violation of any of the above prohibitions may result in immediate termination of your account and access to our services, and may subject you to civil or criminal liability under applicable United States federal and state law.

5. Ordering and Payment Terms

5.1 Order Placement

When you place an order through our Site, you are making an offer to purchase the selected food items. We reserve the right to accept or decline any order at our discretion. An order is not confirmed until you receive an order confirmation via email or on-screen notification. We are not responsible for orders that are not confirmed due to technical errors, payment failures, or other issues.

5.2 Pricing

All prices listed on the Site are in United States Dollars (USD) and are subject to change without notice. Applicable sales tax will be calculated and added to your order total at checkout, in accordance with applicable state and local tax laws. Prices do not include delivery fees, which may be assessed separately based on your location and the applicable delivery service.

5.3 Payment Methods

5.4 Refunds and Cancellations

Order cancellations may be accepted if requested before preparation of your order has begun. Once food preparation has started, cancellations may not be possible.

Any promotional codes, coupons, or discounts offered by Dewey's Pizza are subject to specific terms and conditions associated with each promotion. Promotions cannot be combined unless expressly stated. We reserve the right to modify, suspend, or terminate any promotion at any time without prior notice.

6. Intellectual Property Rights

The Site and all of its content, features, and functionality — including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, digital downloads, software, and the compilation thereof — are the exclusive property of Dewey's Pizza or its content licensors and are protected by United States and international intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.), trademark laws, and other applicable statutes and regulations.

The Dewey's Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company. You may not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for personal, non-commercial purposes to order food and interact with our services. This license does not include the right to:

  • Reproduce, modify, distribute, display, or perform any content from the Site;
  • Create derivative works based on Site content;
  • Use any data mining, robots, or similar data gathering or extraction methods;
  • Download or copy account information for the benefit of any third party;
  • Use the Site or any content thereon for commercial purposes without our express written consent.

Any unauthorized use of our intellectual property will constitute a breach of these Terms and may violate applicable intellectual property laws, which could result in civil and/or criminal penalties.

7. Disclaimers and "As-Is" Basis

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, SERVICES, AND PRODUCTS AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DEWEY'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
  • WARRANTIES THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR CURRENTNESS OF ANY INFORMATION PROVIDED ON THE SITE;
  • WARRANTIES THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

While we make every effort to maintain the accuracy of menu information, including ingredients and allergen data, we cannot guarantee that all information is current, complete, or free from error. Customers with food allergies, dietary restrictions, or other health conditions are strongly encouraged to contact us directly before placing an order to confirm ingredient and allergen information. Dewey's Pizza shall not be liable for any adverse reactions, health consequences, or injuries resulting from consumption of our food products.

We do not warrant or make any representations regarding the use, accuracy, or results of the use of the materials on the Site in terms of their correctness, accuracy, reliability, or otherwise.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW IN THE UNITED STATES, IN NO EVENT SHALL DEWEY'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
  • DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES;
  • DAMAGES RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES;
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
  • DAMAGES RESULTING FROM ANY THIRD-PARTY CONDUCT ON THE SITE;
  • DAMAGES RESULTING FROM ANY FOOD PRODUCTS ORDERED THROUGH THE SITE, EXCEPT AS MAY BE REQUIRED BY APPLICABLE LAW.

IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

IN ANY CASE, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE AND SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This limitation of liability section shall apply to the fullest extent permitted by law in the applicable jurisdiction.

9. Indemnification

You agree to defend, indemnify, and hold harmless Dewey's Pizza, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms of Service;
  • Your use of the Site or services in a manner not authorized by these Terms;
  • Your violation of any applicable law, regulation, or the rights of any third party, including any intellectual property rights or privacy rights;
  • Any content you submit, post, or transmit through the Site;
  • Your negligence, willful misconduct, or fraud;
  • Any claim arising from your use of or reliance on any information provided on the Site.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate with our defense of such claim. You shall not settle any matter without the prior written consent of Dewey's Pizza. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

10. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Dewey's Pizza. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not warrant or make any representations regarding the accuracy of information found on any linked third-party sites.

If we use third-party delivery platforms, payment processors, or other service providers to facilitate our services, those providers operate under their own terms and privacy policies, which you are encouraged to review. Your interactions with such third-party providers are governed by their respective terms, and we are not responsible for any issues arising from your use of such third-party services.

We strongly advise you to read the terms of service and privacy policies of any third-party websites that you visit. Your use of third-party services is at your own risk.

11. Food Safety and Allergen Notice

Dewey's Pizza takes food safety seriously and complies with all applicable federal and state food safety regulations, including those enforced by the U.S. Food and Drug Administration (FDA) and applicable state health departments. However, please be aware of the following:

  • Our food products are prepared in a kitchen where common allergens — including but not limited to wheat/gluten, dairy, eggs, nuts, soy, shellfish, and fish — are present. Cross-contamination is possible.
  • If you have a food allergy or dietary restriction, please contact us at [email protected] prior to placing your order to discuss your specific needs.
  • We cannot guarantee that any menu item is completely free from any specific allergen.
  • Menu items, ingredients, and preparation methods may change without notice. Always verify current ingredient information before ordering.

12. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Dewey's Pizza operates, without giving effect to any choice-of-law or conflict-of-law provisions.

To the extent that any dispute is not subject to arbitration as set forth in Section 13 below, you consent to the exclusive jurisdiction and venue of the federal and state courts located in the applicable jurisdiction of the United States, and you waive any objection to the exercise of personal jurisdiction over you by such courts and any objection to venue in such courts.

These Terms are subject to all applicable federal consumer protection laws, including the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) and any applicable state consumer protection statutes. Users located in California shall have additional rights as provided under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), as well as other applicable California statutes.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact Dewey's Pizza at [email protected] and provide a written description of the dispute, the relief you are seeking, and your contact information. We will attempt to resolve any dispute informally within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally within this period, either party may proceed with the formal dispute resolution process described below.

13.2 Binding Arbitration

EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT, ANY AND ALL DISPUTES, CONTROVERSIES, OR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR OUR SERVICES SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, WHICH ARE INCORPORATED BY REFERENCE INTO THESE TERMS.

The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration agreement.

13.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND DEWEY'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

13.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies under the rules of that court, provided that the action remains in small claims court and is not removed or transferred to another court.

14. Term and Termination

These Terms shall remain in full force and effect while you use the Site or maintain an account with us. We reserve the right, in our sole discretion, to:

  • Suspend or terminate your access to the Site and services at any time and for any reason, including but not limited to your violation of these Terms;
  • Remove any content you have submitted to the Site;
  • Take any other action we deem necessary to protect the Site, our customers, and our business.

Upon termination of your account or your access to the Site for any reason:

  • The license granted to you under these Terms will immediately terminate;

  • All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Changes to These Terms

We reserve the right to revise, amend, or modify these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will:

If any provision of these Terms of Service is held by a court of competent jurisdiction or arbitrator to be invalid, illegal, unenforceable, or in conflict with any applicable law or regulation, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted from these Terms. The validity, legality, and enforceability of the remaining provisions of these Terms shall not in any way be affected or impaired, and they shall continue in full force and effect as if the invalid, illegal, or unenforceable provision had never been contained herein.

The failure of Dewey's Pizza to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. A waiver by either party of any term or condition of these Terms, or any breach thereof, in any one instance, shall not waive such term or condition or any subsequent breach thereof.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, shall constitute the entire agreement between you and Dewey's Pizza concerning the Site and services and supersede all prior and contemporaneous agreements, representations, warranties, and understandings with respect to the Site, services, and the subject matter of these Terms, whether written or oral.

No oral or written information or advice given by Dewey's Pizza, its agents, employees, or representatives shall create a warranty unless expressly set forth in these Terms. In the event of a conflict between these Terms and any other agreement you may have with Dewey's Pizza, these Terms shall control unless the other agreement specifically supersedes these Terms in writing.

18. Accessibility
